Fence installer wins £5,500 payout for crush injury

James Wood was employed by a fencing company, installing heavy metal railing gates at a private property. He said “I was manoeuvring one of the steel gates into place using a swinging motorised arm. The clamps provided to help balance the gates on the arm were worn and defective and so I couldn’t use them.” Because of the lack of clamps to secure the load, the gate fell to the ground
causing a severe injury to some of Mr Wood’s fingers. He made a claim for compensation with Rapid Solicitors. A Solicitor at Rapid said: “It was a nasty injury which resulted in Mr Wood being compensated for pain, suffering and some loss of amenity in the hand. We also recovered a substantial amount of damages for our client’s subsequent loss of earnings. With our experience of all types of accidents in the workplace and our expertise in assessment of sometimes highly complex machinery, we were able to present a strong case for liability to the defendants to gain an admission of negligence. Quite simply, it came down to the fact that employers should not be permitting their workers to use defective equipment with a risk to their own safety.”
