Q. How do I know if I have a claim? If you have suffered physical and/or psychological injury through someone else’s fault, you may be entitled to compensation.
Q. What’s my claim worth? If you are successful with your case, you will receive 100% of the Compensation awarded. The amount depends on numerous factors. The main ones are: the severity of your injuries, how long they last, the effect on your life, the effect on your earning power, whether you were partly to blame (known as Contributory Negligence) and loss of income. You can claim for General Damages for the injuries, pain and suffering. You can claim for Special Damages, for all financial losses incurred as a result of the injury, such as costs of medicine, damaged items, travel expenses, loss of earnings and so on. Compensation amounts are calculated based on previous Case Law.
Q. Who can make a compensation claim? If you are 18 years of age or older, you can make a claim on your own behalf. You become known as The Claimant. If you are a minor, below the age of 18, someone will have to claim on your behalf. This is usually a close friend or relative, who will be referred to as the Litigation Friend. If you can’t claim because of injury or incapacitation and are unable to make a decision for yourself, a Litigation Friend will have to make the claim on your behalf. If a person has died, then their dependants or a representative can make a claim on his or her behalf.
Q. Will I have to pay anything? Normally, whatever happens, you receive 100% of any compensation and don’t pay any of the costs. If we win the case, our costs are paid by the Other Side. Your case will be fought by us on a No Win No Fee basis. This Agreement is also known as a Conditional Fee Agreement or CFA.
Q. How long will fighting the case take? We are called Rapid Solicitors, because we chase every step of the way – and there can be quite a few steps. So, our aim is to be faster than any other Solicitor in progressing and settling your case. How long a case takes depends on the complexity of the case and whether or not the Defendants admit liability.
