Delivery man in fall from truck wins £7,000 payout
Tony White was making his usual delivery of foodstuffs to a café, when he slipped from the side loading door of his truck and fell 4 feet onto the concrete below. He sustained a broken elbow, broken wrist and severe bruising to his hip and ribs. Mr White said: “I fell because the floor was slippery and there were no hand grips or rails to grab hold of, to prevent falls. The truck was so full of stock I had to climb over things in order to get in and out and reach the shelves.” Mr White’s injuries were so severe that he was off work for two months and made a claim for personal injury through Rapid Solicitors. The Defendants admitted liability but alleged 30% fault on the side of their employee. A spokesman at Rapid said: “We didn’t accept that. Our view was that his employer was entirely at fault in that they permitted the entrance and exit to the truck to become and remain a hazard. Once the truck was stocked, Mr White could barely move in there. They had a statutory duty to ensure safety with regard to that.” He continued: “Once liability had been established, the next step was to employ the best medical experts to assess our client’s injuries, so we could fight for the maximum amount of his rightful compensation. It sounds like a lot of money, but Mr White was in considerable pain for several weeks and absent from work for months.”
